Common Injuries Caused by Dogs in Dallas, Texas
Dogs are a beloved part of millions of Texas families. However, a dog that is aggressive, anxious, or poorly trained can bite another person with no warning, leading to devastating and sometimes fatal injuries.
Even small breeds possess powerful canines which are capable of inflicting deep puncture wounds and large lacerations, often resulting in scarring and infections. Babies, children, and elderly individuals are particularly susceptible to serious complications. Some common examples of injuries and health problems resulting from dog bites can include:
- Broken Bones
- Cuts and Lacerations
- Facial Injuries
- Finger Amputation
- Nerve Damage
- Puncture Wounds
- Throat and Neck Injuries
- Scarring and Disfigurement
- Torn Ligaments
- Vision Loss
- Wrongful Death
Though less common, dogs can also cause injuries in ways other than biting. For instance, a dog that gets too excited or aggressive can jump on a person, knocking them over and causing them to strike their head, back, or other parts of the body. This type of scenario can lead to a back injury, traumatic brain injury, concussion, hip fracture, or other injury.
Dog Breeds Most Likely to Attack People
Pit Bulls inarguably receive the most media coverage when a fatal mauling or dog attack occurs anywhere in the United States. While it’s true that Pit Bulls account for a disproportionately high number of dog bites – as many as 76%, by some estimates – they are not the only breed to be associated with a large number of serious or fatal bite wounds. In fact, some of the most aggressive breeds are those typically perceived as friendly, family-oriented dogs, such as the Labrador Retriever and Saint Bernard.
According to the American Veterinary Medical Association, dog breeds most likely to bite or attack include the:
- Chow Chow
- Cocker Spaniel
- German Shepherd
- Jack Russell Terrier
- Labrador Retriever
- Lhasa Apso
- Saint Bernard
- Shih Tzu
- Springer Spaniel
Though the trend is not exclusive to any particular breed, Texas reports more fatal dog attack injuries than any other state in the country, with 34 bite-related deaths occurring between January 2005 and February 2013.
Mail carriers have an especially high risk of being bitten or mauled. Nearly 60 postal carriers were attacked in Dallas alone during 2015.
Are Pet Owners Liable for Dog Bite Injuries in Dallas?
Every state follows different legal standards with regard to owner liability for dog bite injuries. While Texas does not currently possess an explicit dog bite liability statute, prior court cases have set a precedent for determining bite liability.
When a person is bitten by a pet dog in Dallas, the owner or person who was controlling the dog at the time of the attack may be liable under the “one bite rule” if the attack victim can prove that the dog owner:
- Was aware that the animal had a history of violent or aggressive behavior.
- Acted negligently in restraining or controlling the dog, leading to a preventable bite injury. Failure to comply with Dallas leash laws, or leash laws in other cities, could be an example. Negligence, which is a critical element of personal injury claims and lawsuits, means that a person failed to exercise reasonable, adequate precautions that were necessary in order to prevent or minimize the risk of, a foreseeable accident, such as a dog biting somebody.
