Arlington, TX Uber + Lyft Accident Lawyer

Table of Contents

Many Uber and Lyft drivers are amateur drivers who make extra money on the side by driving for these rideshare companies.  Many of these drivers may not have the training and experience to drive safely and consistently.  Other drivers are professional drivers who use Uber and Lyft as an alternative to driving a taxi or luxury vehicle.  These drivers may also put others at risk if they become tired after long shifts or turn to drugs or alcohol to stay alert on the road.

In either case, if your Uber or Lyft driver caused an accident while you were riding in the car, you may be entitled to sue them for financial compensation.  Even if you were the driver of another car, a pedestrian, or a cyclist hit by an Uber or Lyft driver, you may be entitled to compensation.  Call the Arlington Uber and Lyft accident attorneys at The Queenan Law Firm today for help filing a lawsuit to seek compensation for your injuries.  For a free legal consultation, call (817) 476-1797 today.

Suing for an Uber or Lyft Accident

Uber and Lyft approve and pay drivers through their smartphone apps, but these companies do not directly employ the drivers they work with.  Instead, these drivers are independent contractors – which effectively means that they are self-employed.  Under this system, you cannot typically sue Uber or Lyft for an accident, but you can file your case against the driver directly.

When you are injured in a car accident, you will need to sue the driver who caused the crash to seek compensation for your injuries.  If you were an Uber or Lyft passenger, this may be the Uber/Lyft driver or another driver who hit your car.  If you were injured in another car that was hit by an Uber or Lyft, of if you were injured as a pedestrian or while riding a bike, you may be entitled to sue the Uber or Lyft driver for injuries.

This driver is required by law to carry insurance that should be able to cover an accident.  As an Uber or Lyft driver, this insurance policy must be a commercial driving policy or include rideshare coverage that should entitle you to high coverage if the driver injured you.

In addition to the driver’s own policy, Uber and Lyft do provide additional insurance coverage for accidents that occur while the driver is using their app.  If the driver is between rides but has the app open, a policy covering $50,000 per accident should supplement the driver’s coverage.  If the driver already accepted a ride or had a passenger in the car when the crash happened, a larger $1 million insurance policy should cover the accident.

    Damages in an Uber Lawsuit

The damages you are entitled to in your injury case will depend on the injuries you suffered in the crash.  Typically, damages are available for lost wages, medical bills, and pain and suffering.  However, you may need to file a lawsuit to maximize these damages, since insurance payouts and settlements might now pay the full value of your case.

Lost wages from a car accident typically include wages you missed if your injury required you to take time off work to recover.  If your injury causes future lost wages or reduces your earning capacity, you can also claim damages for these financial losses.  Furthermore, an injury causing a permanent disability or physical limitation might prevent you from going back to work entirely.  These future lost wages should be covered in full, and your lawyer and a financial expert can help calculate these damages and prove them in court.

Whether your injury was mild or severe, you likely faced some medical treatment if you suffered injuries in the crash.  For a mild or moderate injury case, this could include X-rays, doctor’s appointments, and checkups.  More severe injuries might require surgeries, hospitalization, ongoing home care, rehabilitation, physical therapy, and other costs.  These damages should be covered in full, and filing a lawsuit might be the best way to maximize the compensation.

You can also claim damages on top of these economic damages to pay you directly for your pain and suffering.  This includes compensation for the physical pain and discomfort you faced as well as the other intangible effects of injury, such as depression and emotional distress, mental anguish, loss of enjoyment in life, and other harms.  You can prove these damages to a jury by testifying and answering your lawyer’s questions about how the injury affected you.

In many injury cases, the damages offered in a settlement or through an insurance claim are too low to cover your full damages.  Insurance may pay only a percentage of medical costs and lost wages, and these payments typically do not cover pain and suffering.  To get your full compensation, you may need to take your case to court and file it as a personal injury lawsuit.  Your attorney can help you understand what your case is worth, whom to sue, and how to best handle your case to maximize the financial compensation you receive.
